Essential Things One Should Consider Before Buying Land in Tanzania

Understand Land Ownership and Land Categories

In Tanzania, all land is public property, managed on behalf of citizens by the president. The Ownership is through a leasehold system, where you can be granted the right to use the land for a specified period typically ranging from 33 to 99 years.

There are three (3) categories of land in Tanzania i.e General Land, Village Land, and Reserved Land. And each category has different regulations and management systems.

Understand the Legal Procedures:

When purchasing land in Tanzania, it is important to note that you are acquiring rights to the land, not the land itself. The process of acquiring land differs for foreign investors compared to Tanzanian nationals. It is essential to fully comprehend the procedures and requirements for obtaining the right of occupancy and making investments through the Tanzania Investment Center (TIC).

Professional Consultation

Connect with a certified attorney, experienced surveyors, and a land registry representative to verify the authenticity of the transaction.

Conduct Due Diligence

When considering the purchase of real property, whether it involves a building or land, it is essential to conduct thorough inspections and due diligence. This necessitates careful consideration of two crucial aspects.

  1. Physical verification example onsite visitation
  2. Documentation verification example official search to the local government offices or the register in the Register of the Ministry of Lands.

When engaging in real estate transactions, it is imperative to conduct comprehensive documentation verification to prevent potential land disputes. A clear understanding of the property’s boundaries, existing encumbrances, and land use restrictions is essential for a thorough due diligence process.

Location and Infrastructure

Consider the land’s Proximity to amenities, access to Transportation, infrasture, security and future development plans to ensure it meets your needs.

N.B: Remember, it’s essential to have a clear understanding of the legal framework and to proceed carefully when buying land in Tanzania to ensure your investment is secure.
